Expertise

Jaap specialises in the various fields of EU and competition law, including public procurement, commercial activities of public institutions, privatization, free trade within the Internal Market, state aid and antitrust procedures (investigations of cartels, abuse of dominant positions and notifications of mergers and acquisitions).

Experience

Jaap has assisted major customers on issues relating to public law regulations and free competition in various sectors like energy and media. He represented clients in disputes and proceedings before the European Commission, the EU Courts in Luxembourg, Dutch courts, Dutch Competition Law Authority (ACM), and other supervisory bodies. He was involved in various ACM (phase two) merger control procedures (cable networks, biscuits, industrial gases, newspapers).

He represents the Dutch national broadcasting organisation NPO in its dispute with the ACM and the daily newspaper De Telegraaf on compulsory licensing of programme listings. Furthermore, he was involved in various ACM and EU Commission cartel investigations (industrial gases, beer, bicycles, sugar, flour, construction, cleaning, catering and security services, retail, electricity and gas, consumer electronics). He assisted clients in civil litigation cases on the petrol station contracts, sport sponsoring and public ownership restrictions of nuclear power generators.

He advised companies and branch associations in various types of contracts and cooperation like selective distribution, franchise networks, purchase pricing policies of supermarkets, industrial tolling agreements, video-on-demand services, collective copyright licensing, recycling systems of packaging of consumer products, long-distance public rail transport connections in Europe, and groundhandling monopolies at airports.

Jaap graduated from Groningen University in 1980 and has been working for the Rotterdam office of NautaDutilh for more than 20 years. In 2014, he joined Ploum.
